I. – The provision of free samples of a plasma referred to in the second paragraph of article L. 1223-6 is only permitted during the two years following its initial inclusion or modification on the list of characteristics included in the decision of the Agence nationale de sécurité du médicament et des produits de santé (French National Agency for the Safety of Medicines and Health Products) referred to in 1° of article L. 1221-8.
II. – The provision of free samples also complies with the following conditions:
1° Each supply of samples is in response to a written, dated and signed request from the professional making the request;
2° For each plasma mentioned in article L. 1223-3, no more than four samples may be supplied per year and per recipient; each sample being identical to the smallest packaging on the market;
3° Each person providing samples organises the control of such provision and ensures that the samples are monitored;
4° Each sample is accompanied by a copy of the written document containing the information mentioned in article R. 1223-1.
In accordance with the provisions of Article L. 5312-1, the Director General of the Agence nationale de sécurité du médicament et des produits de santé may restrict or suspend the distribution of samples of certain plasmas mentioned in Article L. 1223-3, in particular their number and frequency of distribution, on the grounds of a danger to human health.
