Article R123-138 of the French Commercial code

Where a person has been struck off automatically pursuant to this section, he or she may, provided that he or she shows that he or she has regularised his or her situation, ask the Registrar to report the striking off.

Within a period of fifteen days from the date of the request, the Registrar shall make the report or deliver a reasoned decision of refusal to the applicant against a receipt or send it to the applicant by registered letter with acknowledgement of receipt.

The applicant may refer the refusal or lack of response by the registrar to the judge appointed to oversee the register within fifteen days of the notification provided for in the previous paragraph.

Lorsqu’une personne a été radiée d’office en application de la présente section, elle peut, dès lors qu’elle démontre qu’elle a régularisé sa situation, demander au greffier de rapporter cette radiation.

Dans le délai de quinze jours à compter de la demande, il procède au rapport ou remet une décision motivée de refus au demandeur contre récépissé ou la lui adresse par lettre recommandée avec demande d’avis de réception.

Le demandeur peut saisir le juge commis à la surveillance du registre du refus ou de l’absence de réponse du greffier dans les quinze jours suivant la notification prévue à l’alinéa précédent.
