Article R123-89 of the French Commercial code

A notary who draws up a deed that has any impact on the parties concerned in terms of the register is required to complete the corresponding formalities by sending a file to the single body, in accordance with the procedure laid down in article R. 123-1, on pain of a civil fine of 15 to 750 euros imposed by the judicial court, without prejudice to the application of disciplinary sanctions and the incurrence of liability, guaranteed under the conditions set out in Chapter III of Decree no. 55-604 of 20 May 1955 relating to public or ministerial officers and certain auxiliary officers of the court.

Le notaire qui rédige un acte comportant, pour les parties intéressées, une incidence quelconque en matière de registre est tenu de procéder aux formalités correspondantes par la transmission d’un dossier à l’organisme unique, selon la procédure prévue à l’article R. 123-1, à peine d’une amende civile de 15 à 750 euros prononcée par le tribunal judiciaire, sans préjudice de l’application de sanctions disciplinaires et de l’engagement de sa responsabilité, garantie dans les conditions prévues au chapitre III du décret n° 55-604 du 20 mai 1955 relatif aux officiers publics ou ministériels et à certains auxiliaires de justice.
