He checks that the statements comply with the legislative and regulatory provisions, correspond to the supporting documents and deeds filed in the appendix and are compatible, in the case of an application for amendment or cancellation, with the status of the file.

He also verifies that the incorporation or amendments to the articles of association of commercial companies comply with the legislative and regulatory provisions governing them.

The Registrar also checks that the natural person required to be entered in the register or, in the case of a legal entity, its legal representative is not entered in the national file mentioned in article L. 128-1.

Verification by the Registrar of the existence of the declaration, authorisation, title or diploma required by the applicable regulations to carry on the business is only carried out if the conditions for carrying on the business must be fulfilled personally by the person required to be registered or by one of the persons mentioned in the register pursuant to this section.

Il vérifie que les énonciations sont conformes aux dispositions législatives et réglementaires, correspondent aux pièces justificatives et actes déposés en annexe et sont compatibles, dans le cas d’une demande de modification ou de radiation, avec l’état du dossier.

Il vérifie en outre que la constitution ou les modifications statutaires des sociétés commerciales sont conformes aux dispositions législatives et réglementaires qui les régissent.

Le greffier vérifie également que la personne physique tenue à l’immatriculation au registre ou, s’il s’agit d’une personne morale, son représentant légal n’est pas inscrit au fichier national mentionné à l’article L. 128-1.

La vérification par le greffier de l’existence des déclaration, autorisation, titre ou diplôme requis par la réglementation applicable pour l’exercice de l’activité n’est effectuée que si les conditions d’exercice doivent être remplies personnellement par la personne tenue à l’immatriculation ou par l’une des personnes mentionnées au registre en application de la présente section.
