Article R1241-11 of the French Public Health Code

The persons exercising parental authority or, where applicable, the minor’s guardian, shall send the committee of experts referred to in article R. 1231-5 a request for authorisation to take the sample, accompanied by a copy of the documents by which their consent was obtained.

The committee of experts hears the minor who is capable of discernment. It shall ensure that the minor who is capable of expressing his or her wishes does not refuse the removal. It decides on the removal under the conditions set out in articles R. 1231-8 and R. 1231-9. It asks the doctor who indicated the transplant to provide proof that every effort has been made to find an adult donor compatible with the recipient.

Les personnes investies de l’exercice de l’autorité parentale ou le cas échéant le tuteur du mineur du mineur adressent au comité d’experts mentionné à l’article R. 1231-5 une demande d’autorisation de prélèvement, accompagnée d’une copie des actes par lesquels a été recueilli leur consentement.

Le comité d’experts entend le mineur capable de discernement. Il s’assure qu’il n’existe de la part du mineur apte à exprimer sa volonté aucun refus du prélèvement. Il se prononce sur le prélèvement dans les conditions prévues aux articles R. 1231-8 et R. 1231-9. Il demande au médecin qui a posé l’indication de greffe d’apporter la preuve que tous les moyens ont été mis en oeuvre pour trouver un donneur majeur compatible avec le receveur.
