Article R1241-4 of the French Public Health Code

When a person wishes to have haematopoietic cells collected from bone marrow or peripheral blood, he/she expresses his/her consent before the president of the judicial court or his/her delegate under the conditions defined in articles R. 1231-2 and R. 1231-3.

In the event of a life-threatening emergency, consent is obtained by the public prosecutor under the conditions defined in article R. 1231-4.

These provisions apply to a protected adult who is not the subject of a legal protection measure with representation relating to the person.

Article R1241-4

Lorsqu’une personne souhaite faire l’objet d’un prélèvement de cellules hématopoïétiques recueillies dans la moelle osseuse ou le sang périphérique, elle exprime son consentement devant le président du tribunal judiciaire ou son délégué dans les conditions définies aux articles R. 1231-2 et R. 1231-3.

En cas d’urgence vitale, le consentement est recueilli par le procureur de la République dans les conditions définies à l’article R. 1231-4.

Ces dispositions sont applicables au majeur protégé qui ne fait pas l’objet d’une mesure de protection juridique avec représentation relative à la personne.
