I.-When the body is returned to the contact person designated by the donor, to a family member or to a close relative, this person is designated as the person entitled to provide for the funeral. The body is returned by the designated funeral operator at the expense of this person. An order by the Minister for Higher Education sets the conditions for the financial responsibility for the transfer of the body to the establishment authorised in application of the second paragraph of article L. 1261-1 when the body has been transferred to another establishment authorised under the same conditions.
The body is first placed in a closed coffin corresponding to the characteristics prescribed in articles R. 2213-20, R. 2213-25 to R. 2213-27 of the General Local Authorities Code, at the expense and under the responsibility of the establishment. The provisions of article R. 2213-45 of the same code do not apply. The body may only be transported under the conditions set out in articles R. 2213-21 and R. 2213-22 of the same code. The person entitled to provide for the funeral ensures the burial or cremation of the donor’s body without delay, in accordance with articles R. 2213-31 and R. 2213-34 of the same code.
The burial or cremation deadlines provided for in articles R. 2213-33 and R. 2213-35 of the same code run from the date on which the body is returned to the person entitled to provide for the funeral.
II.-When the establishment proceeds with the cremation of the body, in particular when this is made necessary by the nature of the activities associated with the use of the body, the ashes are returned to the contact person designated by the donor, a family member or a close friend. This person is designated as the person entitled to provide for the funeral. The designated funeral operator will return the ashes at the expense of this person.
The destination of the ashes is organised under the conditions set out in articles L. 2223-18-1 to L. 2223-18-4 of the same code.
