Article R1261-19 of the French Public Health Code

I.-The ethics, scientific and teaching committee of the body’s host structure comprises between ten and twenty members divided into two colleges:

1° A college made up of leading figures from the establishment authorised in accordance with the second paragraph of article L. 1261-1 and, where applicable, from the associated establishment in accordance with article R. 1261-11, recognised for their expertise in the scientific, training and research, and technical fields. It includes in particular:

a) Teacher-researchers in the field of health;

b) Teacher-researchers in the field of the humanities and social sciences, qualified in particular in law, ethics, philosophy or sociology, working in the establishment;

c) A technician working in the structure hosting the bodies;

2° A college made up of personalities from outside the authorised establishment, at regional or inter-regional level, including at least :

a) A person recognised for their expertise in ethical and scientific issues, who may be a member of a recognised ethical body;

b) A researcher or teacher-researcher in the human and social sciences, qualified in particular in law, ethics, philosophy or sociology;

c) A professional working in the field of health, who may be a psychologist;

d) A health professional with expertise in research involving the human person, who may be a professional from a university hospital centre;

e) At least one representative of donors or their families.

The number of members of the second college may not be less than half of the total number.

The members of the first college are appointed by the head of the establishment authorised in accordance with the second paragraph of article L. 1261-1. If an establishment is associated with it as permitted by article R. 1261-11, the persons proposed by this establishment are appointed by the head of the authorised establishment. The members of the second college are appointed by the rector of the academic region, chancellor of the universities, in which the establishment is based.

The members of the committee are appointed for a term of four years, renewable once. In the event of loss of membership, a replacement is appointed under the same conditions for the remainder of the term.

II – Public establishments providing medical training may be partners of an establishment authorised to house a body reception facility. The number of members on the committee may be increased for each of the colleges by as many members as necessary. In this case, the heads of the respective establishments shall appoint members of the first college from among the staff on duty in these establishments.

Article R1261-19

I.-Le comité d’éthique, scientifique et pédagogique de la structure d’accueil des corps comprend entre dix et vingt membres répartis en deux collèges :

1° Un collège composé de personnalités de l’établissement autorisé conformément au deuxième alinéa de l’article L. 1261-1 et, le cas échéant, de l’établissement associé conformément à l’article R. 1261-11 reconnues pour leurs compétences dans les domaines scientifiques, de la formation et de la recherche, et techniques. Il comprend notamment :

a) Des enseignants-chercheurs dans le domaine de la santé ;

b) Des enseignants-chercheurs dans le domaine des sciences humaines et sociales qualifiés notamment en droit, éthique, philosophie ou sociologie en fonction dans l’établissement ;

c) Un technicien en fonction dans la structure d’accueil des corps ;

2° Un collège composé de personnalités extérieures à l’établissement autorisé, de niveau régional ou interrégional, dont au moins :

a) Une personnalité reconnue pour son expertise sur les questions éthiques et scientifiques et qui peut être membre d’une instance éthique reconnue ;

b) Un chercheur ou enseignant-chercheur des sciences humaines et sociales qualifié notamment en droit, éthique, philosophie ou sociologie ;

c) Un professionnel exerçant dans le domaine de la santé, qui peut être un psychologue ;

d) Un professionnel de santé compétent en matière de recherche impliquant la personne humaine qui peut-être un professionnel de centre hospitalo-universitaire ;

e) Au moins un représentant des donneurs ou de leurs familles.

Le nombre de membres du second collège ne peut être inférieur à la moitié de l’effectif total.

Les membres du premier collège sont désignés par le responsable de l’établissement autorisé conformément au deuxième alinéa de l’article L. 1261-1. Si un établissement lui est associé comme le permet l’article R. 1261-11, les personnalités proposées par cet établissement sont désignées par le responsable de l’établissement autorisé. Ceux du second collège sont désignés par le recteur de la région académique, chancelier des universités, au sein de laquelle l’établissement a son siège.

Les membres du comité sont désignés pour un mandat de quatre ans renouvelable une fois. En cas de perte de la qualité pour siéger, un remplaçant est désigné dans les mêmes conditions pour la durée du mandat restant à courir.

II.-Des établissements publics dispensant des formations médicales peuvent être partenaires d’un établissement autorisé à héberger une structure d’accueil des corps. L’effectif du comité peut être augmenté pour chacun des collèges d’autant de membres que nécessaire. Dans ce cas, leurs responsables respectifs désignent parmi les personnels en fonctions dans ces établissements des membres au titre du premier collège.
