Article R1261-3 of the French Public Health Code

The establishment authorised in accordance with the second paragraph of article L. 1261-1 which has obtained the consent provided for in the first paragraph of that same article shall ensure that the transport operations are completed within a maximum of forty-eight hours from the date of death without it being necessary to comply with the conditions laid down in articles R. 2213-33 and R. 2213-35 of the General Local Authorities Code.

The costs of transporting the body are fully covered by the establishment that obtained the consent provided for in the first paragraph of Article L. 1261-1 of this Code.

An order of the Minister for Higher Education shall specify the procedures for applying this article and determine the conditions under which a body may be transferred to another establishment authorised under the same conditions.

Article R1261-3

L’établissement autorisé conformément au deuxième alinéa de l’article L. 1261-1 qui a recueilli le consentement prévu au premier alinéa de ce même article s’assure que les opérations de transport sont achevées dans un délai maximum de quarante-huit heures à compter du décès sans qu’il soit nécessaire de respecter les conditions prévues aux articles R. 2213-33 et R. 2213-35 du code général des collectivités territoriales.

Les frais afférents à l’acheminement du corps sont intégralement pris en charge par l’établissement ayant recueilli le consentement prévu au premier alinéa de l’article L. 1261-1 du présent code.

Un arrêté du ministre chargé de l’enseignement supérieur précise les modalités d’application du présent article et détermine les conditions dans lesquelles un corps peut être transféré vers un autre établissement autorisé dans les mêmes conditions.
