Article R127-3 of the French Commercial code

Before any registration or entry in the Trade and Companies Register, the Special Register for Sole Proprietorships with Limited Liability, the Special Register for Commercial Agents or the National Register of Companies, or when the economic activity does not require registration, the beneficiary of the contract shall indicate on invoices, order notes, advertising documents as well as on all correspondence and all receipts concerning his activity and signed by him in his name and more generally on his business papers that he is benefiting from a support contract for the creation or takeover of an economic activity. He shall also mention on these documents the company name, the location of the registered office and the identification number of the legal entity responsible for the support, as well as the term of the contract.

Where the nature of the activity requires registration, the obligations of the beneficiary and the procedures for publicising the business project support contract for the creation or takeover of an economic activity are laid down for traders by the provisions of this code relating to the trade and companies register, for companies registered in the special register of sole proprietorships with limited liability by the relevant provisions of this Code, for commercial agents by the provisions of this Code relating to the special register of commercial agents and, for other companies, by the provisions of this Code relating to the National Register of Companies.

Avant toute immatriculation ou inscription au registre du commerce et des sociétés, au registre spécial des entreprises individuelles à responsabilité limitée, au registre spécial des agents commerciaux ou au Registre national des entreprises, ou lorsque l’activité économique ne requiert pas d’immatriculation, le bénéficiaire du contrat indique sur les factures, notes de commande, documents publicitaires ainsi que sur toutes correspondances et tous récépissés concernant son activité et signés par lui en son nom et plus généralement sur ses papiers d’affaires qu’il bénéficie d’un contrat d’appui pour la création ou la reprise d’une activité économique. Il mentionne également sur ces documents la dénomination sociale, le lieu du siège social et le numéro d’identification de la personne morale responsable de l’appui, ainsi que le terme du contrat.

Lorsque la nature de l’activité requiert une immatriculation, les obligations du bénéficiaire et les modalités de publicité du contrat d’appui au projet d’entreprise pour la création ou la reprise d’une activité économique sont fixées pour les commerçants par les dispositions du présent code en matière de registre du commerce et des sociétés, pour les entreprises immatriculées au registre spécial des entreprises individuelles à responsabilité limitée par les dispositions du présent code en la matière, pour les agents commerciaux par les dispositions du présent code en matière de registre spécial des agents commerciaux et, pour les autres entreprises, par les dispositions du présent code en matière de Registre national des entreprises.
