Article R131-16 of the French Commercial code

The chairman and members of the jury are appointed by order of the Minister for Trade, on the recommendation of the Minister of Justice, in the case of the chairman, on the recommendation of the National Disciplinary Commission of Consular Magistrates, in the case of consular judges, and on the recommendation of the National Council of Sworn Commodity Brokers, in the case of sworn commodity brokers.

The chairman and members of the jury may not serve for more than three consecutive years.

The jury is assisted by one or more technicians for the category of goods for which the broker is applying to be sworn in. These technicians, appointed as broker members of the jury, have an advisory vote.

Le président et les membres du jury sont désignés par arrêté du ministre chargé du commerce, sur proposition du garde des sceaux, ministre de la justice, en ce qui concerne le président, sur proposition de la commission nationale de discipline des magistrats consulaires, en ce qui concerne les juges consulaires, et sur proposition du Conseil national des courtiers de marchandises assermentés, en ce qui concerne les courtiers de marchandises assermentés.


Le président et les membres du jury ne peuvent siéger plus de trois années consécutives.


Le jury est assisté d’un ou plusieurs techniciens de la catégorie de marchandises pour laquelle le courtier demande à être assermenté. Ces techniciens, désignés comme courtiers membres du jury, ont voix consultative.
