Article R131-2 of the French Code of civil enforcement procedures

For the application of article L. 131-3, lack of jurisdiction is raised ex officio by the judge hearing an application for the liquidation of an astreinte.

Except where it emanates from a court of appeal, the judge’s decision may be appealed in accordance with the conditions laid down in the Code of Civil Procedure.

Article R131-2

Pour l’application de l’article L. 131-3, l’incompétence est relevée d’office par le juge saisi d’une demande en liquidation d’astreinte.

Si ce n’est lorsqu’elle émane d’une cour d’appel, la décision du juge peut faire l’objet d’un appel formé dans les conditions prévues par le code de procédure civile.
