Article R131-21 of the French Commercial code

The prosecuted sworn freight broker and the Public Prosecutor are notified of the decision by registered letter with acknowledgement of receipt. The notification shall indicate the time limit and procedures for appealing against the decision.

This appeal is lodged with the Court of Appeal.

It must be lodged within one month by declaration to the court registry or by registered letter with acknowledgement of receipt sent to the court registry.

The time limit runs, with regard to the public prosecutor, from the day the decision is handed down and, with regard to the sworn goods broker, from the day the decision is notified.

La décision est notifiée au courtier de marchandises assermenté poursuivi, par lettre recommandée avec demande d’avis de réception, et au ministère public. La notification indique le délai et les modalités du recours ouvert à l’encontre de la décision.


Ce recours est porté devant la cour d’appel.


Il est formé dans le délai d’un mois par déclaration au greffe ou par lettre recommandée avec demande d’avis de réception adressée au greffe.


Le délai court, à l’égard du procureur de la République, du jour du prononcé de la décision et, à l’égard du courtier de marchandises assermenté, du jour de la notification de la décision.
