Article R131-40 of the French Commercial code

The office of the Conseil national des courtiers de marchandises assermentés (National Council of Sworn Freight Brokers) hears complaints and claims from third parties, after having heard or duly summoned, in the form prescribed above, the sworn freight brokers concerned as well as the complainants. The latter may be heard and, in all cases, may be assisted by a sworn freight broker or a lawyer.

The deliberations of the bureau shall state the reasons on which they are based and shall be signed by the chairman and the secretary at the meeting at which they are taken. Each decision shall contain the names of the members present.

The deliberations of the Executive Committee shall be notified, where applicable, in the same form as summonses, and a mention thereof shall be made by the secretary in the margin of the said deliberations. Where appropriate, they are communicated to the public prosecutor with territorial jurisdiction.

Le bureau du Conseil national des courtiers de marchandises assermentés connaît des plaintes et réclamations des tiers, après avoir entendu ou dûment appelé, dans la forme ci-dessus prescrite, les courtiers de marchandises assermentés intéressés ainsi que les plaignants. Ceux-ci peuvent être entendus et, dans tous les cas, peuvent se faire assister par un courtier de marchandises assermenté ou un avocat.

Les délibérations du bureau sont motivées et signées par le président et le secrétaire, à la séance même où elles sont prises. Chaque délibération contient les noms des membres présents.

Les délibérations du bureau sont notifiées, quand il y a lieu, dans la même forme que les citations, et il en est fait mention par le secrétaire, en marge desdites délibérations. Elles sont, le cas échéant, communiquées au procureur de la République territorialement compétent.
