Article R1321-13-1 of the French Public Health Code

The declaration of the public interest in the abstraction of water for human consumption referred to in article L. 1321-2 is published in the departmental registry of administrative acts and is displayed in the town hall of each of the municipalities concerned for at least two months. A notice of this posting is published in conspicuous characters in two local newspapers.

The beneficiary of the easements will also send an extract of this deed to each interested owner to inform them of the easements affecting their land, by registered letter with acknowledgement of receipt. If the identity or address of an owner is unknown, the notice is sent to the mayor of the municipality in which the property subject to the easements is located, who posts it and, if applicable, informs the occupier of the premises.

The mayors of the municipalities concerned keep the deed declaring the easement to be in the public interest and provide any person who requests it with information about the easements attached to it.

L’acte portant déclaration d’utilité publique des travaux de prélèvement d’eau destinée à la consommation humaine mentionné à l’article L. 1321-2 est publié au recueil des actes administratifs de l’Etat dans le département et est affiché à la mairie de chacune des communes intéressées pendant au moins deux mois. Une mention de cet affichage est insérée en caractères apparents dans deux journaux locaux.

Un extrait de cet acte est par ailleurs adressé par le bénéficiaire des servitudes à chaque propriétaire intéressé afin de l’informer des servitudes qui grèvent son terrain, par lettre recommandée avec demande d’avis de réception. Lorsque l’identité ou l’adresse d’un propriétaire est inconnue, la notification est faite au maire de la commune sur le territoire de laquelle est située la propriété soumise à servitudes, qui en assure l’affichage et, le cas échéant, la communique à l’occupant des lieux.

Les maires des communes concernées conservent l’acte portant déclaration d’utilité publique et délivrent à toute personne qui le demande les informations sur les servitudes qui y sont rattachées.
