Article R1321-19 of the French Public Health Code

To carry out the analysis programme provided for in articles R. 1321-10, R. 1321-15, R. 1321-15-1 and R. 1321-16 and for the additional analyses provided for in articles R. 1321-17 and R. 1321-18, water samples are taken by agents of the Regional Health Agency or by agents of a laboratory approved under the conditions mentioned in article R. 1321-21.

With the exception of the cases provided for in article R. 1321-18, the cost of sampling is borne by the person responsible for producing, distributing or packaging the water, at the rates and in accordance with the procedures laid down by order of the ministers responsible for local authorities, consumer affairs, the economy and finance and health.

Article R1321-19

Pour la réalisation du programme d’analyse prévu aux articles R. 1321-10, R. 1321-15, R. 1321-15-1 et R. 1321-16 et pour les analyses complémentaires prévues aux articles R. 1321-17 et R. 1321-18, les prélèvements d’échantillons d’eau sont effectués par les agents de l’agence régionale de santé ou par les agents d’un laboratoire agréé dans les conditions mentionnées à l’article R. 1321-21.

Les frais de prélèvement sont, à l’exception des cas prévus à l’article R. 1321-18, à la charge de la personne responsable de la production, de la distribution ou du conditionnement d’eau aux tarifs et selon les modalités fixés par arrêté des ministres chargés des collectivités territoriales, de la consommation, de l’économie et des finances et de la santé.
