For water supplied by a public distribution service, analyses from the programme mentioned in article R. 1321-23 may replace those carried out in application of article R. 1321-15 when the following two conditions are met:
1° A quality management system is set up by the person responsible for water production or distribution.
An order by the Minister for Health specifies the conditions under which the analyses carried out by the person responsible for water production or distribution are taken into account and the supporting documents to be produced;
2° Monitoring samples and analyses are taken by a laboratory that meets the requirements defined by order of the Minister for Health. These samples and analyses are carried out by a laboratory accredited by the French Accreditation Committee or by any other accreditation body that has signed a multilateral recognition agreement within the framework of the European Coordination of Accreditation Bodies, to carry out samples and analyses of the parameters concerned.
The results of these monitoring analyses are sent at least once a month to the Director General of the Regional Health Agency, who forwards them to the Prefect with his comments.
These provisions may apply to some of the analyses, under the conditions laid down by the ministerial order referred to in article R. 1321-15.
A prefectoral order, issued after consultation with the departmental council for the environment and health and technological risks, defines the conditions for taking into account the monitoring carried out by the person responsible for water production or distribution.
