Article R1321-33 of the French Public Health Code

In exceptional circumstances, a second derogation, for a maximum period of three years, may be granted by the Prefect, on the basis of a report by the Director General of the Regional Health Agency, for the cases provided for in 1° and 2° of I of article R. 1321-31. The request, accompanied by the file, must be sent to the Prefect no later than six months before the end of the derogation period and must include an interim report justifying this second request. The Prefect’s decision includes the information specified in 2° of article R. 1321-32.

If the Prefect remains silent for more than six months, this is deemed to be a decision of acceptance.

Article R1321-33

Dans des circonstances exceptionnelles, une seconde dérogation, d’une durée maximale de trois ans, peut être accordée par le préfet, sur le rapport du directeur général de l’agence régionale de santé, pour les cas prévus aux 1° et 2° du I de l’article R. 1321-31. La demande, accompagnée du dossier, doit être adressée au préfet au plus tard six mois avant la fin de la période dérogatoire et comporter un bilan provisoire justifiant cette seconde demande. L’arrêté du préfet comprend les éléments indiqués au 2° de l’article R. 1321-32.

Le silence gardé par le préfet pendant plus de six mois vaut décision d’acceptation.
