The import of packaged drinking water, other than natural mineral water, and of food ice of water origin is subject to authorisation issued by the prefect of the department in which the importer seeking authorisation for first release for consumption in France is based, provided that it meets the requirements of this code. If the application for import authorisation remains unanswered for more than six months, it will be deemed to have been rejected. A copy of the prefectoral authorisation must be presented during a customs inspection.
However, authorisation is not required for imports of packaged waters and water-based ice from a Member State of the European Union or another State party to the Agreement on the European Economic Area, imported under the same designations as in the country of origin.
