Article R1322-17 of the French Public Health Code

The application for a natural mineral water spring to be declared to be in the public interest and for a protective perimeter to be assigned to it, as provided for in article L. 1322-3, is sent to the Prefect.

This application may be attached to the application for authorisation to operate, submitted in application of article L. 1322-1.

The application file includes in particular

1° In the case of an application for a declaration of public interest, the reasons for the application and a description of the conditions under which the source will be exploited;

2° In the case of a request for a protective perimeter, a justification of the area and easements requested, as well as the opinion of the approved public health hydrogeologist, specially appointed by the Director General of the Regional Health Agency to study the application.

The information contained in the dossier is specified by an order of the Minister for Health.

The Director General of the Regional Health Agency obtains the opinion of the approved public health hydrogeologist under the conditions set out in article R. 1321-14. This opinion relates in particular to the exploitation rate, the justification and determination of the protection perimeter and the protection measures to be implemented.

If the perimeter of protection requested is located in different départements, the prefect of the département where the spring is to be exploited coordinates the procedure.

Article R1322-17

La demande tendant à faire déclarer d’intérêt public une source d’eau minérale naturelle et à lui assigner un périmètre de protection, tel que prévu à l’article L. 1322-3, est adressée au préfet.

Cette demande peut être jointe à la demande d’autorisation d’exploiter, présentée en application de l’article L. 1322-1.

Le dossier de la demande comprend notamment :

1° Pour une demande de déclaration d’intérêt public, la motivation de la demande et la description des conditions d’exploitation de la source ;

2° Pour une demande d’assignation d’un périmètre de protection, une justification de l’emprise et des servitudes sollicitées, ainsi que l’avis de l’hydrogéologue agréé en matière d’hygiène publique, spécialement désigné par le directeur général de l’agence régionale de santé pour l’étude du dossier.

Les informations figurant au dossier sont précisées par un arrêté du ministre chargé de la santé.

Le directeur général de l’agence régionale de santé recueille l’avis de l’hydrogéologue agréé en matière d’hygiène publique dans les conditions prévues à l’article R. 1321-14. Cet avis porte notamment sur le débit d’exploitation, la justification et la détermination du périmètre de protection et les mesures de protection à mettre en oeuvre.

Dans le cas où le périmètre de protection sollicité est situé dans des départements différents, le préfet du département où est envisagé le lieu d’exploitation de la source coordonne la procédure.
