The application for a natural mineral water spring to be declared to be in the public interest and for a protective perimeter to be assigned to it, as provided for in article L. 1322-3, is sent to the Prefect.
This application may be attached to the application for authorisation to operate, submitted in application of article L. 1322-1.
The application file includes in particular
1° In the case of an application for a declaration of public interest, the reasons for the application and a description of the conditions under which the source will be exploited;
2° In the case of a request for a protective perimeter, a justification of the area and easements requested, as well as the opinion of the approved public health hydrogeologist, specially appointed by the Director General of the Regional Health Agency to study the application.
The information contained in the dossier is specified by an order of the Minister for Health.
The Director General of the Regional Health Agency obtains the opinion of the approved public health hydrogeologist under the conditions set out in article R. 1321-14. This opinion relates in particular to the exploitation rate, the justification and determination of the protection perimeter and the protection measures to be implemented.
If the perimeter of protection requested is located in different départements, the prefect of the département where the spring is to be exploited coordinates the procedure.
