Article R1322-6 of the French Public Health Code

The Prefect of the Department in which the final exploitation site of the spring is located, after obtaining the opinion of the hydrogéologue agréé en matière d’hygiène publique, specially appointed for this purpose, submits a summary report drawn up by the Director General of the Regional Health Agency and a reasoned draft order to the Departmental Council for the Environment and Health and Technological Risks for its opinion.

The Prefect sends the draft order to the applicant and informs him of the date and location of the meeting of the Departmental Council. The applicant or his representative may ask to be heard by the departmental council or submit written observations to the Prefect.

If the installations are located in different départements, the prefect of the département where the final operation of the source is planned coordinates the procedure.

Article R1322-6

Le préfet du département d’implantation du lieu d’exploitation final de la source, après avoir recueilli l’avis de l’hydrogéologue agréé en matière d’hygiène publique, spécialement désigné à cet effet, soumet un rapport de synthèse établi par le directeur général de l’agence régionale de santé et un projet d’arrêté motivé à l’avis du conseil départemental de l’environnement et des risques sanitaires et technologiques.

Le préfet transmet le projet d’arrêté au demandeur et l’informe de la date et du lieu de la réunion du conseil départemental. Le demandeur ou son mandataire peut demander à être entendu par le conseil départemental ou présenter ses observations écrites au préfet.

Dans le cas où les installations sont situées dans des départements différents, le préfet du département où est envisagé le lieu d’exploitation final de la source coordonne la procédure.
