I. – Any production of clean seawater is subject to authorisation from the Prefect of the département in which the production facility is located.
The authorisation is issued on the basis of a file containing in particular:
1° The name of the person responsible for production at the facility concerned, if this person is not the author of the application for authorisation;
2° Information enabling the water quality to be assessed;
3° An analysis of the risks associated with production, in particular with regard to the quality of the clean seawater produced.
The information contained in the dossier is specified by a joint order of the Minister for Health and the Minister for Agriculture, issued after consultation with the Agence nationale de sécurité sanitaire de l’alimentation, de l’environnement et du travail.
The costs of compiling the dossier are borne by the applicant.
II. – The Prefect will issue a reasoned decision on the application for authorisation to produce clean seawater, based in particular on the risk analysis carried out by the person responsible for this production.
The order granting the authorisation shall mention, in particular, the identity of the holder, the production site and zone, the conditions under which the seawater is taken and the methods for monitoring the quality of the clean seawater.
III. – Any change in the conditions of seawater withdrawal and clean seawater production must be the subject of a request to amend the prefectoral authorisation order. The authorisation holder must provide the Prefect with all the information required to assess the project prior to its implementation.
IV. – Any change in the holder of the authorisation, without any change in the operating conditions, must be declared to the Prefect, who will amend the existing authorisation order.
