Article R1322-74 of the French Public Health Code

In the event of non-compliance with the provisions of articles R. 1322-70 to R. 1322-73 or the individual decisions taken for their application, the Prefect will send the person responsible for the production of clean seawater formal notice to put an end to the shortcomings observed within a time limit that he will set. This formal notice specifies the measures to be implemented and sets a deadline for submitting observations. If the person responsible for production does not comply with the formal notice, the Prefect may prohibit the production of clean seawater at the facility in question until it complies with the obligations arising from the aforementioned provisions.

En cas de non-respect des dispositions des articles R. 1322-70 à R. 1322-73 ou des décisions individuelles prises pour leur application, le préfet adresse au responsable de la production d’eau de mer propre une mise en demeure de faire cesser les manquements constatés dans un délai qu’il fixe. Cette mise en demeure précise les mesures à mettre en œuvre et impartit un délai pour présenter des observations. Si le responsable de production ne se conforme pas à la mise en demeure, le préfet peut interdire la production d’eau de mer propre dans l’installation en cause jusqu’à sa mise en conformité avec les obligations résultant des dispositions précitées.
