Article R1323-3 of the French Public Health Code

For the purposes of this chapter, the following definitions shall apply

1° Adverse reaction means a noxious reaction occurring under normal conditions of use of a foodstuff in humans or resulting from use which does not comply with its intended purpose, its usual use or its instructions for use or the special precautions for use indicated on its labelling;

2° Serious adverse reaction: an adverse reaction which warrants hospitalisation or results in permanent or temporary functional incapacity, disability, immediate threat to life, death or a congenital anomaly or malformation.

Article R1323-3

Pour l’application du présent chapitre, on entend par :

1° Effet indésirable une réaction nocive se produisant dans les conditions normales d’emploi d’une denrée alimentaire chez l’homme ou résultant d’une utilisation non conforme à sa destination, à son usage habituel ou à son mode d’emploi ou aux précautions particulières d’emploi mentionnées sur son étiquetage ;

2° Effet indésirable grave, un effet indésirable qui justifie soit une hospitalisation, soit entraîne une incapacité fonctionnelle permanente ou temporaire, une invalidité, une mise en jeu du pronostic vital immédiat, un décès ou une anomalie ou une malformation congénitale.
