Article R1331-17 of the French Public Health Code

The following are by nature unfit for habitation and may not therefore be made available for habitation, whether free of charge or in return for payment, in application of article L. 1331-23 :

1° Cellars, regardless of any alterations or modifications made to them;

2° Basements, attics, rooms with insufficient ceiling height, living rooms with no opening to the outside, or rooms with insufficient natural light or a cramped layout, unless they meet the requirements set out in articles R. 1331-18 to R. 1331-23 respectively.

Article R1331-17

Sont par nature impropres à l’habitation et ne peuvent en conséquence être mis à disposition aux fins d’habitation, à titre gratuit ou onéreux, par application de l’article L. 1331-23 :

1° Les caves, quels que soient les aménagements et transformations qui leur sont apportés ;

2° Les sous-sols, les combles, les pièces dont la hauteur sous plafond est insuffisante, les pièces de vie dépourvues d’ouverture sur l’extérieur, ou celles dépourvues d’éclairement naturel suffisant ou de configuration exiguë, sauf s’ils répondent aux exigences respectivement fixées par les articles R. 1331-18 à R. 1331-23.
