I.-Any discovery of a radioactive source outside of a regulated use within the framework of a nuclear activity regime is declared without delay to the representative of the State in the department, who informs the Nuclear Safety Authority.
Old radioactive objects are considered to be radioactive sources.
II – The management of the radioactive source depends on its origin and its owner:
1° When the radioactive source originates from a nuclear activity that is or has been subject to a regime mentioned in article L. 1333-8 or article L. 1333-9, the person responsible for the nuclear activity takes back the source and applies the provisions of its regime;
2° Where the radioactive source is an old radioactive object, its owner is responsible for its disposal by the National Agency for Radioactive Waste Management, in accordance with 6° of Article L. 542-12 du code de l’environnement ;
3° If the person responsible fails to act or is not identified, the radioactive source is considered to be an orphan radioactive source.
Orphan radioactive sources are managed by the State. The representative of the State in the département asks the National Agency for Radioactive Waste Management, as part of its general interest mission mentioned in the tenth paragraph of Article L. 542-12 of the Environment Code, to take back these orphan sources and manage them as radioactive waste as defined in Article L. 542-1-1 du code de l’environnement.
An order by the ministers responsible for radiation protection, risk prevention and energy specifies the terms and conditions for the involvement of the National Agency for Radioactive Waste Management in the collection and recovery of orphan sources.
