I.-It is forbidden
1° To transfer, whether temporarily or permanently, electrical equipment emitting ionising radiation, accelerators and radioactive sources, whether in return for payment or free of charge, to any natural or legal person who is not in possession of a receipt for a declaration or who is not the holder of a registration or authorisation decision under one of the regimes mentioned in article L. 1333-8 or L. 1333-9 when the possession of radioactive sources, accelerators or electrical equipment emitting ionising radiation that is the subject of the transfer is subject to one of these regimes;
2° Acquire radioactive sources, accelerators or electrical equipment emitting ionising radiation from a person who does not have the distribution authorisation referred to in Article R. 1333-126 if this authorisation is required. This provision does not apply to transfers between users.
II – Exemptions to the prohibition mentioned in 2° of I may be granted to the purchaser by the authority that issued the authorisation to hold or distribute the radioactive sources or electrical equipment emitting ionising radiation whose acquisition is envisaged.
III – The provisions of I and II are applicable to the ionising radiation sources mentioned in 1°, 2°, 3°, 5° and 6° of Article R. 1333-152.
