Article R1333-163 of the French Public Health Code

The amount of the financial guarantee required by Article R. 1333-162 is established on the basis of a national scale which defines a take-back cost taking into account the nature of the radionuclide, the initial activity of the sealed radioactive source and the existence or absence of a disposal route in France. This amount takes into account the take-back cost set by the national scale and the number of sealed radioactive sources that will be taken back from users.

The Nuclear Safety Authority shall arrange for the financial guarantee to be implemented in the event that the supplier or holder fails to fulfil the take-back obligation as provided for in II of Article R. 1333-161.

When a holder defaults in the performance of the take-back obligation at the request of the Nuclear Safety Authority, the supplier may activate the financial guarantee.

Le montant de la garantie financière exigée à l’article R. 1333-162 est établi sur la base d’un barème national qui définit un coût de reprise en prenant en compte la nature du radionucléide, l’activité initiale de la source radioactive scellée et l’existence ou l’absence d’une filière d’élimination en France. Ce montant tient compte du coût de reprise fixé par le barème national et du nombre de sources radioactives scellées qui seront reprises aux utilisateurs.

L’Autorité de sûreté nucléaire fait mettre en œuvre la garantie financière en cas de défaillance du fournisseur ou du détenteur dans l’exécution de l’obligation de reprise telle que prévue au II de l’article R. 1333-161.

Lorsque la reprise est assurée auprès d’un détenteur défaillant sur demande de l’Autorité de sûreté nucléaire, le fournisseur peut mettre en œuvre la garantie financière.
