Article R1333-48 of the French Public Health Code

In the event of the use of a new technology intended for radiotherapy, radiosurgery, diagnosis or radioguided interventional practices, or of a new type of practice carried out using an existing technology, an order by the Minister for Health, issued after consultation with healthcare professionals and the opinion of the competent bodies, may lay down, on a transitional basis, special provisions for collecting and analysing information concerning the expected benefits for the patient and the associated risks, including for the professionals involved in the care.

This decree sets the duration of the transitional period.

The information is collected and analysed in accordance with recommendations for good professional practice. The information and its analysis are sent to the Haute Autorité de Santé and the Autorité de Sûreté Nucléaire at their request.

En cas d’utilisation d’une nouvelle technologie destinée à la radiothérapie, à la radiochirurgie, au diagnostic ou aux pratiques interventionnelles radioguidées, ou d’un nouveau type de pratique réalisé avec une technologie existante, un arrêté du ministre chargé de la santé, pris après consultation des professionnels de santé et avis des instances compétentes, peut prévoir, à titre transitoire, des dispositions particulières pour recueillir et analyser des informations concernant les bénéfices attendus pour le patient et les risques associés, y compris pour les professionnels qui participent aux soins.

Cet arrêté fixe la durée de la période transitoire.

Le recueil et l’analyse des informations sont effectués conformément aux recommandations de bonnes pratiques professionnelles. Les informations et leur analyse sont transmises à la Haute autorité de santé et à l’Autorité de sûreté nucléaire à leur demande.
