Article R1334-14 of the French Public Health Code

I.-The articles of this section apply, unless otherwise stipulated, to buildings for which planning permission was issued before 1st July 1997, whether they belong to private or public persons.

II – In this section, the term “owner” means :

1° For the buildings mentioned in article R. 1334-15, the owner or owners of the built property;

2° For the private portions of buildings mentioned in article R. 1334-16, the owner or owners of the private portion;

3° For the buildings referred to in article R. 1334-17, the owner or owners of the building or, in the case of joint ownership, the joint owners’ association;

4° For the buildings mentioned in article R. 1334-18, the owner or owners of the building, or the syndicate of co-owners in the case of joint ownership.

III -If the owner or owners mentioned in 4° of II of this article cannot be identified, the obligations incumbent upon them under the provisions of this section are the responsibility of the operator or operators of the building.

IV-The lists A, B and C of materials and products likely to contain asbestos, mentioned in this section, are detailed in appendix 13-9 of this code.

Article R1334-14

I.-Les articles de la présente section s’appliquent, sauf disposition contraire, aux immeubles bâtis dont le permis de construire a été délivré avant le 1er juillet 1997, qu’ils appartiennent à des personnes privées ou publiques.

II.-Dans cette section, on entend par les termes le propriétaire :

1° Pour les immeubles mentionnés à l’article R. 1334-15, le ou les propriétaires de l’immeuble bâti ;

2° Pour les parties privatives d’immeubles mentionnées à l’article R. 1334-16, le ou les propriétaires de la partie privative ;

3° Pour les immeubles mentionnés à l’article R. 1334-17, le ou les propriétaires de l’immeuble, ou, en cas de copropriété, le syndicat des copropriétaires ;

4° Pour les immeubles mentionnés à l’article R. 1334-18, le ou les propriétaires de l’immeuble, ou le syndicat des copropriétaires en cas de copropriété.

III.-A défaut que le ou les propriétaires mentionnés au 4° du II du présent article aient pu être identifiés, les obligations leur incombant en application des dispositions de la présente section sont à la charge du ou des exploitants de l’immeuble.

IV.-Les listes A, B et C de matériaux et produits susceptibles de contenir de l’amiante, mentionnées dans la présente section, sont détaillées à l’annexe 13-9 du présent code.
