Article R1334-23 of the French Public Health Code

The surveys provided for in articles R. 1334-20 to R. 1334-22 as well as the periodic assessment of the state of preservation provided for in article R. 1334-27 and the visual examination provided for in article R. 1334-29-3 are carried out by persons who meet the conditions laid down in article L. 271-6 of the Code de la Construction et de l’Habitation.

When the result of the assessment of the state of preservation leads to the recommendations provided for in 2° or 3° of IV of article R. 1334-20, the person who has carried out the identification of the materials and products in list A in an existing building mentioned in article R. 1334-17 or article R. 1334-18 sends a copy of the identification report to the prefect of the département in which the existing building is located. An order issued by the ministers responsible for construction and health specifies the terms and conditions of this transmission.

As stipulated in article R. 271-2-1 of the French Construction and Housing Code, the persons mentioned in the first paragraph send an annual activity report to the ministers responsible for construction and health. In drawing up this report, they shall take account of the results of the analyses referred to in article R. 1334-24, which shall be communicated to them by the accredited bodies referred to in article R. 1334-24 responsible for carrying out these analyses.

Article R1334-23

Les repérages prévus aux articles R. 1334-20 à R. 1334-22 ainsi que l’évaluation périodique de l’état de conservation prévue à l’article R. 1334-27 et l’examen visuel prévu à l’article R. 1334-29-3 sont réalisés par des personnes répondant aux conditions posées par les dispositions de l’article L. 271-6 du code de la construction et de l’habitation.

Lorsque le résultat de l’évaluation de l’état de conservation conduit aux préconisations prévues au 2° ou 3° du IV de l’article R. 1334-20, la personne ayant effectué le repérage des matériaux et produits de la liste A dans un immeuble bâti mentionné à l’article R. 1334-17 ou à l’article R. 1334-18 transmet une copie du rapport de repérage au préfet du département du lieu d’implantation de l’immeuble bâti. Un arrêté des ministres chargés de la construction et de la santé précise les modalités de cette transmission.

Comme prévu à l’article R. 271-2-1 du code de la construction et de l’habitation, les personnes mentionnées au premier alinéa adressent aux ministres chargés de la construction et de la santé un rapport annuel d’activité. Pour l’établissement de ce rapport, elles tiennent compte des résultats des analyses mentionnées à l’article R. 1334-24, qui leur sont communiqués par les organismes accrédités mentionnés à l’article R. 1334-24 chargés d’effectuer ces analyses.
