I. – Notwithstanding the provisions of article R. 1334-29, the deadline for completion of the work may, at the owner’s request, be extended for work concerning the high-rise buildings mentioned in article R. 122-2 of the Code de la construction et de l’habitation and establishments open to the public defined in article R. 123-2 of this same code, classified in the first to third categories within the meaning of article R. 123-19, where list A materials and products containing asbestos have been used for general treatment.
II – The request for an extension must be submitted by the owner to the Prefect of the département in which the building is located, within twenty-seven months of the date of submission of the survey report or the results of the dust measurements or the assessment of the state of conservation which concluded that the work needed to be carried out, except where unforeseeable circumstances, duly justified, make it impossible to meet this deadline.
III – The extension is granted, for a maximum period of thirty-six months, by order of the Prefect made after obtaining the opinion of the Haut Conseil de la santé publique, taking into account the risks specific to the building or establishment concerned, the occupation of the site and the conservation measures implemented in application of the second paragraph of article R. 1334-29. If the Prefect remains silent for more than four months, the application will be rejected.
IV – The extension may be renewed once under the same conditions and for as long as is strictly necessary in the light of the information submitted to the Prefect, if, due to exceptional circumstances, the work cannot be completed within the timeframe set by the first extension.
