The following is punishable by a fifth-class fine:
1° Failure by the owners of establishments open to the public mentioned in article D. 1333-32 to carry out the periodic radon measurements provided for in II of article R. 1333-33 ;
2° If the reference level set in article R. 1333-28 is exceeded, for the owners of establishments open to the public mentioned in article D. 1333-32, failing to have the expert assessment provided for in II of article R. 1333-34 carried out, or failing to check the effectiveness of the corrective actions and work carried out within the time limits provided for in III of the same article;
3° Carrying out the services mentioned in I of article R. 1333-36 without being approved;
4° Carrying out the analysis of passive integrated radon measurement devices referred to in article R. 1333-30 without being accredited.
The agents mentioned in Article L. 1333-24 are authorised by the Director General of the Regional Health Agency to investigate and record these offences.
