Article R1338-5 of the French Public Health Code

In order to prevent the appearance or to combat the proliferation of the species appearing on the list provided for in article L. 1338-1 and which are likely to harm human health, any owner, tenant, operator, manager of built or unbuilt land, beneficiary or occupier in any capacity whatsoever shall implement, within a period defined by the prefectoral order mentioned in article R. 1338-4, the measures determined in this same order.

Article R1338-5

Afin de prévenir l’apparition ou de lutter contre la prolifération des espèces figurant sur la liste prévue à l’article L. 1338-1 et qui sont de nature à porter atteinte à la santé humaine, tout propriétaire, locataire, exploitant, gestionnaire de terrains bâtis et non bâtis, ayant droit ou occupant à quelque titre que ce soit met en œuvre, dans un délai défini par l’arrêté préfectoral mentionné à l’article R. 1338-4, les mesures déterminées dans ce même arrêté.
