Article R134-13-1 of the French Commercial code

When a commercial agent has assigned to his professional activity assets separate from his personal assets pursuant to the provisions of article L. 526-6, and transfers his domicile within the meaning of article R. 134-6 within the jurisdiction of another court, he shall apply for a new registration through the single body mentioned in article R. 123-1 and shall indicate, together with this application, the place and register of the previous registration.

The newly competent registrar shall request, within one clear working day of the new registration, the registrar of the court within whose jurisdiction the activity was carried on to proceed with the transfer within one clear working day of receipt of his request. The clerk of the court previously responsible will automatically remove the commercial agent’s registration from its register. Each registry shall inform the commercial agent, via the single body, of the steps taken.

Article R134-13-1

Lorsqu’un agent commercial a affecté à son activité professionnelle un patrimoine séparé de son patrimoine personnel en application des dispositions de l’article L. 526-6, et qu’il transfère son domicile au sens de l’article R. 134-6 dans le ressort d’un autre tribunal, il demande une nouvelle immatriculation par l’intermédiaire de l’organisme unique mentionné à l’article R. 123-1 et indique, conjointement à cette demande, le lieu et le registre de l’immatriculation antérieure.

Le greffier nouvellement compétent demande, dans le délai d’un jour franc ouvrable à compter de la nouvelle immatriculation, au greffier du tribunal dans le ressort duquel était exercée l’activité de procéder au transfert dans le délai d’un jour franc ouvrable à compter de la réception de sa demande. Le greffier antérieurement compétent procède d’office à la radiation de l’immatriculation de l’agent commercial de son registre. Chaque greffe informe l’agent commercial, par l’intermédiaire de l’organisme unique, des diligences accomplies.
