Article R1340-10 of the French Public Health Code

I.-Health professionals shall report without delay to the body responsible for toxicovigilance in their area any case of human intoxication that they observe and which presents one of the following seriousness criteria for the person intoxicated:

1° Death ;

2° Life-threatening;

3° Temporary or permanent functional impairment;

4° hospitalisation for more than twenty-four hours.

II -Health professionals also declare :

1° Cases of intoxication covered by specialised monitoring systems defined by orders of the Minister for Health;

2° Cases of intoxication which, although they do not meet one of the criteria mentioned in I, appear to them to be unusual or to present a risk to public health.

III -Health professionals shall inform the person or, in the event of death and in compliance with the provisions of article L. 1110-4, their heirs of the transmission of health data concerning them.

IV-The provisions of the present article do not apply when the declaration comes under another regulated system of vigilance relating to the products defined in articles L. 5311-1, L. 5141-1 and R. 1323-1.

Article R1340-10

I.-Les professionnels de santé déclarent sans délai à l’organisme chargé de la toxicovigilance territorialement compétent tout cas d’intoxication humaine qu’ils constatent et présentant pour la personne intoxiquée l’un des critères de gravité suivants :

1° Décès ;

2° Mise en jeu du pronostic vital ;

3° Déficit fonctionnel temporaire ou permanent ;

4° Hospitalisation de plus de vingt-quatre heures.

II.-Les professionnels de santé déclarent en outre :

1° Les cas d’intoxication faisant l’objet des dispositifs de surveillance spécialisée définis par arrêtés du ministre chargé de la santé ;

2° Les cas d’intoxication qui, bien que ne répondant pas à l’un des critères mentionnés au I, leur paraissent avoir un caractère inhabituel ou présenter un risque pour la santé publique.

III.-Les professionnels de santé informent la personne ou, en cas de décès et dans le respect des dispositions de l’article L. 1110-4, ses ayants droit de la transmission des données de santé la concernant.

IV.-Les dispositions du présent article ne s’appliquent pas lorsque la déclaration relève d’un autre système réglementé de vigilance relatif aux produits définis aux articles L. 5311-1, L. 5141-1 et R. 1323-1.
