Any healthcare professional or any legal representative of a healthcare establishment, medico-social establishment or service or autonomous cosmetic surgery facility must declare without delay to the Director General of the Regional Health Agency the occurrence of any healthcare-associated infection meeting at least one of the following criteria :
1° The healthcare-associated infection is unexpected or unusual due to :
a) Either the nature or characteristics, in particular the anti-infectious drug resistance profile, of the pathogen involved ;
b) the location or circumstances in which the infection occurs in the people affected;
2° The healthcare-associated infection occurs in the form of clustered cases;
3° The healthcare-associated infection has resulted in death;
4° The healthcare-associated infection is subject to compulsory transmission of individual data to the health authority in application of article L. 3113-1.
This declaration is made without prejudice to the declaration obligations mentioned in articles L. 1123-10, L. 1211-7-1, L. 1221-13, L. 1340-4, L. 5121-25, L. 5212-2, L. 5222-3, R. 1413-68, and L. 3113-1.
A declaration in respect of healthcare-associated infection is equivalent to a declaration in respect of article L. 331-8-1 of the Code de l’action sociale et des familles.
