Article R1435-9-2 of the French Public Health Code

If the doctor has set up a private practice or is working as a private practice associate or locum, he/she is only eligible for the start of practice contract if he/she has been practising for less than one year. The date of establishment taken into account for the conclusion of the contract is that of the student’s first registration on the roll of a Departmental Medical Council.

When the student works as a replacement in accordance with the provisions of article L. 4131-2 in one or more of the areas defined in article R. 1435-9-1, he/she is deemed eligible for the contract to start practising.

During the course of the contract, the signatory may amend the contract to change the main place of practice within the same region, provided that the new place of practice meets the conditions laid down in article R. 1435-9-1.

Lorsque le médecin est installé en cabinet libéral ou lorsqu’il exerce en tant que collaborateur libéral ou remplaçant, il n’est éligible au contrat de début d’exercice qu’à la condition d’exercer depuis moins d’un an. La date d’installation prise en compte pour la conclusion du contrat est celle de sa première inscription au tableau d’un conseil départemental de l’ordre des médecins.

Lorsque l’étudiant exerce en tant que remplaçant conformément aux dispositions de l’article L. 4131-2 dans une ou plusieurs zones définies à l’article R. 1435-9-1, il est réputé éligible au contrat de début d’exercice.

Au cours du contrat, le signataire peut modifier par avenant au contrat le lieu d’exercice principal au sein de la même région, à condition que le nouveau lieu d’exercice réponde aux conditions prévues à l’article R. 1435-9-1.
