Article R1453-14 of the French Public Health Code

I.-The agreement referred to in article L. 1453-8, the framework of which may be specified by an agreement concluded between one or more national councils of the professional associations concerned and one or more organisations representing the persons concerned, shall specify the conditions under which the offer of a benefit covered by article L. 1453-7 is provided for and shall include the following information in particular:

1° The identity of the parties to the agreement:

a) In the case of a professional referred to in 1° of article L. 1453-4, the surname, first name, position, professional address and, where applicable, the title, speciality or personal identifier in the shared directory of healthcare professionals or, failing this, the registration number with the professional association ;

b) In the case of a student or a person mentioned in 2° of Article L. 1453-4, the surname, first name, name and address of the educational establishment or the organisation to which the student is attached, the unique national student identifier and, where applicable, the personal identifier in the shared directory of healthcare professionals;

c) In the case of a legal entity, in particular an association mentioned in 3° of Article L. 1453-4, the company name, the corporate purpose and the address of the registered office;

d) In the case of a civil servant or an agent of an administrative authority, the surname, first name, the capacity appearing in the appointment order or in the contract, the administrative authority concerned and the professional address;

2° The precise purpose of the agreement in accordance with the thematic typology laid down by order of the Minister for Health, formulated with due respect for legally protected secrets, in particular industrial and commercial secrets;

3° Where applicable, in application of article L. 1453-13, information enabling indirect and final beneficiaries who are not signatories to the agreement to be identified;

4° With regard to benefits in kind or in cash granted:

a) The benefits as well as the information provided according to the thematic typology provided for by the order mentioned in 2° of this article ;

b) The individual amount of each benefit and, where applicable, the cumulative amount of these benefits, all taxes included and rounded to the nearest euro;

5° The date of signature of the agreement and, where applicable, the period during which the benefits are granted and its expiry date.

II-This agreement is accompanied, where applicable, by:

1° The programme for the event ;

2° Authorisation to combine activities from the authority to which the public official concerned reports, pursuant toArticle 10 of Decree no. 2020-69 of 30 January 2020 relating to ethical controls in the civil service;

3° A summary, in French, of the research or evaluation protocol;

4° The draft observation book or data collection document provided for in the protocol for other scientific research or evaluation activities, with the exception of activities covered by the provisions of article L. 1121-16-1.

Article R1453-14

I.-La convention mentionnée à l’article L. 1453-8, dont le cadre peut être précisé par un accord conclu entre un ou plusieurs conseils nationaux des ordres intéressés et une ou plusieurs organisations représentatives des personnes concernées, précise les conditions dans lesquelles l’offre d’un avantage relevant de l’article L. 1453-7 est prévue et comporte notamment les informations suivantes :

1° L’identité des parties à la convention :

a) Lorsqu’il s’agit d’un professionnel mentionné au 1° de l’article L. 1453-4, le nom, le prénom, la qualité, l’adresse professionnelle et, le cas échéant, le titre, la spécialité ou l’identifiant personnel dans le répertoire partagé des professionnels de santé ou, à défaut, le numéro d’inscription à l’ordre ;

b) Lorsqu’il s’agit d’un étudiant ou d’une personne mentionné au 2° de l’article L. 1453-4, le nom, le prénom, le nom et l’adresse de l’établissement d’enseignement ou de l’organisme de rattachement, l’identifiant national étudiant unique et, le cas échéant, l’identifiant personnel dans le répertoire partagé des professionnels de santé ;

c) Lorsqu’il s’agit d’une personne morale, notamment une association mentionnée au 3° de l’article L. 1453-4, la dénomination sociale, l’objet social et l’adresse du siège social ;

d) Lorsqu’il s’agit d’un fonctionnaire ou d’un agent d’une autorité administrative, le nom, le prénom, la qualité figurant dans l’arrêté de nomination ou dans le contrat, l’autorité administrative concernée et l’adresse professionnelle ;

2° L’objet précis de la convention en fonction de la typologie thématique prévue par arrêté du ministre chargé de la santé, formulé dans le respect des secrets protégés par la loi, notamment industriel et commercial ;

3° Le cas échéant, en application de l’article L. 1453-13, les informations permettant d’identifier les bénéficiaires indirects et finaux non signataires de la convention ;

4° S’agissant des avantages en nature ou en espèces octroyés :

a) Les avantages ainsi que les renseignements fournis en fonction de la typologie thématique prévue par l’arrêté mentionné au 2° du présent article ;

b) Le montant individuel de chaque avantage et, le cas échéant, cumulé de ces avantages, toutes taxes comprises et arrondi à l’euro le plus proche ;

5° La date de signature de la convention et, le cas échéant, la période au cours de laquelle les avantages sont octroyés et sa date d’échéance.

II.-Cette convention est accompagnée, le cas échéant :

1° Du programme de la manifestation ;

2° De l’autorisation de cumul d’activités par l’autorité dont relève l’agent public concerné, en application de l’article 10 du décret n° 2020-69 du 30 janvier 2020 relatif aux contrôles déontologiques dans la fonction publique ;

3° Du résumé, rédigé en français, du protocole de recherche ou d’évaluation ;

4° Du projet de cahier d’observations ou du document de recueil des données prévu par le protocole pour les autres activités de recherche ou d’évaluation scientifique à l’exception des activités relevant des dispositions de l’article L. 1121-16-1.
