Article R15-17-3 of the French Code of Criminal Procedure

Investigation assistants may only take up their duties after taking an oath before the judicial court within whose jurisdiction their department or unit of assignment or the location of their training centre, school or instruction centre is situated during their training to perform the duties of an investigation assistant.

The wording of the oath is as follows: “I swear that I will faithfully and impartially perform my duties and observe the duties and reserve that they require of me.
The wording of the oath is as follows: “I swear that I will carry out my duties well and faithfully, and that I will observe the duties and reserve that they require of me. I also swear not to reveal or use anything that comes to my knowledge in the performance of my duties. “

A new oath is not taken in the event of promotion to a higher grade or post or in the event of a change of posting.

Les assistants d’enquête ne peuvent entrer en fonction qu’après avoir prêté serment devant le tribunal judiciaire dans le ressort duquel se trouve leur service ou unité d’affectation ou le lieu d’implantation de leur centre de formation, de leur école ou de leur centre d’instruction durant leur formation aux fonctions d’assistant d’enquête.

La formule du serment est la suivante : “ Je jure de bien et loyalement remplir mes missions, d’observer les devoirs et la réserve qu’elles m’imposent. Je jure également de ne rien révéler ou utiliser de ce qui sera porté à ma connaissance à l’occasion de l’exercice de mes fonctions. ”

Il n’est pas procédé à une nouvelle prestation de serment en cas de passage à un grade ou à un emploi supérieur ou en cas de changement d’affectation.
