Article R15-33-1 of the French Code of Criminal Procedure

The commission provided for in Article 28-1, the assent of which is required for the designation of customs officers in categories A and B authorised to carry out judicial investigations at the request of the public prosecutor or on the basis of a rogatory commission from the examining magistrate, is composed as follows:

1° The Public Prosecutor at the Court of Cassation or his delegate chosen by him from among the First Advocate General or the Advocates General at the Court of Cassation, chairman;

2° Two magistrates from the Public Prosecutor’s Office, no more than one of whom may be an honorary magistrate;

3° The Director General of Customs and Indirect Duties or his representative;

4° The official in charge of the Personnel and Budget Sub-Directorate of the Directorate General of Customs and Indirect Duties or his representative ;

5° The official in charge of the sub-directorate for legal affairs, litigation and the fight against fraud of the directorate general of customs and indirect rights or his representative;

6° An official of the administration of customs and indirect rights with at least the grade of principal inspector;

7° The magistrate delegated to the judicial missions of the customs and tax administration, mentioned in VII of article 28-1, or his representative.

The members of the commission designated above at 2° and 6° shall each have an alternate.

La commission prévue à l’article 28-1 dont l’avis conforme est requis pour la désignation des agents des douanes des catégories A et B habilités à effectuer des enquêtes judiciaires sur réquisition du procureur de la République ou sur commission rogatoire du juge d’instruction est composée comme suit :

1° Le procureur général près la Cour de cassation ou son délégué choisi par lui parmi le premier avocat général ou les avocats généraux à la Cour de cassation, président ;

2° Deux magistrats du ministère public dont un au plus peut être magistrat honoraire ;

3° Le directeur général des douanes et droits indirects ou son représentant ;

4° Le fonctionnaire chargé de la sous-direction du personnel et du budget de la direction générale des douanes et droits indirects ou son représentant ;

5° Le fonctionnaire chargé de la sous-direction des affaires juridiques, contentieuses et de la lutte contre la fraude de la direction générale des douanes et droits indirects ou son représentant ;

6° Un fonctionnaire de l’administration des douanes et droits indirects ayant au moins le grade d’inspecteur principal ;

7° Le magistrat délégué aux missions judiciaires de la douane et de l’administration fiscale, mentionné au VII de l’article 28-1, ou son représentant.

Les membres de la commission désignés ci-dessus aux 2° et 6° ont chacun un suppléant.

Le secrétariat de la commission est assuré par la direction générale des douanes et droits indirects.
