Article R15-33-7 of the French Code of Criminal Procedure

Customs officers may only be authorised to carry out judicial police missions when they are assigned to the financial judicial investigation department of the Ministry of the Budget.

For each of these officers, a request for authorisation is sent to the public prosecutor at the Paris court of appeal by the magistrate delegated to the judicial missions of the customs and tax authorities.

Les agents des douanes ne peuvent être habilités à effectuer des missions de police judiciaire que lorsqu’ils sont affectés au service d’enquêtes judiciaires des finances du ministère du budget.

Pour chacun de ces agents, une demande d’habilitation est adressée au procureur général près la cour d’appel de Paris par le magistrat délégué aux missions judiciaires de la douane et de l’administration fiscale.
