The Public Prosecutor of the place where the judicial police officer usually carries out his duties will order the withdrawal or, for a period not exceeding two years, the suspension of the authorisation to exercise the powers attached to the status of judicial police officer, by an order issued either ex officio or on the proposal of the head of department. The Public Prosecutor will first hear the judicial police officer, who may examine the file relating to the acts of which he or she is accused and be assisted by counsel of his or her choice.
The judicial police officer whose authority has been suspended will automatically resume the exercise of the powers attached to his or her status upon expiry of the suspension. The Public Prosecutor may, at any time, shorten the duration of the suspension.
After a withdrawal, authorisation may only be restored in the same manner as provided for an initial grant.
