Article R1511-5 of the French General Code of Local Authorities

In order to encourage the creation or expansion of economic activities in the investment aid zones for small and medium-sized enterprises for the period 2022-2027 mentioned in Article 3 of Decree no. 2022-968 of 30 June 2022 on regional aid zones and investment aid zones for small and medium-sized enterprises, local authorities or their groupings may, alone or jointly, grant, subject to the provisions of Commission Regulation (EU) No 651/2014 of 17 June 2014 declaring certain categories of aid compatible with the internal market in application of Articles 107 and 108 of the Treaty, the aid referred to in Article L. 1511-3 under the conditions defined below.

In these areas, aid for investment in real estate or for the rental of land or buildings may be granted, in accordance with the provisions of Commission Regulation (EU) No 651/2014 of 17 June 2014 referred to above, to small and medium-sized enterprises as defined in Annex 1 to that Regulation and within the limits and conditions of application set out in paragraphs 2 to 5 of Article 1 of that Regulation.

In these areas, aid for investment in real estate or for renting land or buildings may be granted, in accordance with the provisions of Commission Regulation No 1407/2013 of 18 December 2013 on the application of Articles 107 and 108 of the Treaty on the Functioning of the European Union to de minimis aid, to enterprises other than small and medium-sized enterprises as defined in Annex 1 to the above-mentioned Commission Regulation (EU) No 651/2014 of 17 June 2014.

Afin de favoriser la création ou l’extension d’activités économiques dans les zones d’aide à l’investissement des petites et moyennes entreprises pour la période 2022-2027 mentionnées à l’article 3 du décret n° 2022-968 du 30 juin 2022 relatif aux zones d’aide à finalité régionale et aux zones d’aide à l’investissement des petites et moyennes entreprises, les collectivités territoriales ou leurs groupements peuvent, seuls ou conjointement, accorder, sous réserve des dispositions du règlement (UE) n° 651/2014 de la Commission du 17 juin 2014 déclarant certaines catégories d’aide compatibles avec le marché intérieur en application des articles 107 et 108 du traité, les aides mentionnées à l’article L. 1511-3 dans les conditions définies ci-après.

Dans ces zones, des aides à l’investissement immobilier ou à la location de terrains ou de bâtiments peuvent être accordées, conformément aux dispositions du règlement (UE) n° 651/2014 de la Commission du 17 juin 2014 ci-dessus mentionné, aux petites et moyennes entreprises telles que définies à l’annexe 1 à ce règlement et dans les limites et conditions d’application fixées aux paragraphes 2 à 5 de l’article 1er de ce règlement.

Dans ces zones, des aides à l’investissement immobilier ou à la location de terrains ou de bâtiments peuvent être accordées, conformément aux dispositions du règlement n° 1407/2013 de la Commission du 18 décembre 2013 relatif à l’application des articles 107 et 108 du traité sur le fonctionnement de l’Union européenne aux aides de minimis, aux entreprises autres que les petites et moyennes entreprises au sens de l’annexe 1 du règlement (UE) n° 651/2014 de la Commission du 17 juin 2014 ci-dessus mentionné.
