Article R1524-1 of the French General Code of Local Authorities

A prefect who refers to the regional audit chamber a resolution of the board of directors or the supervisory board or the general meeting of a local semi-public company, pursuant to article L. 1524-2, attach to this referral, in addition to the deliberation, the articles of association and the accounts for the last two financial years.

The Chamber issues a reasoned opinion in which it examines the financial impact of the decision on the situation of the local authorities concerned.

This opinion is sent to the prefect, the shareholder local authorities and the company. It is sent to the statutory auditor for information. As soon as it receives the minutes of the meeting at which the assembly that adopted the resolution gave it a second reading after receiving the Chamber’s opinion, the prefect forwards them to the Chamber.

The minutes of the meeting are sent to the prefect.

Le préfet qui saisit la chambre régionale des comptes d’une délibération du conseil d’administration ou du conseil de surveillance ou de l’assemblée générale d’une société d’économie mixte locale, en application de l’article L. 1524-2, joint à cette saisine, outre la délibération, les statuts et les comptes des deux derniers exercices.

La chambre rend un avis motivé dans lequel elle examine l’incidence financière de la délibération sur la situation des collectivités concernées.

Cet avis est notifié au préfet, aux collectivités actionnaires et à la société. Il est communiqué pour information au commissaire aux comptes. Le préfet transmet à la chambre, dès réception dans ses services, le procès-verbal de la séance au cours de laquelle l’assemblée qui a pris la délibération a procédé à une deuxième lecture de celle-ci après réception de l’avis de la chambre.
