Article R1614-95 of the French General Code of Local Authorities

The allocation under the second fraction of the special assistance is reimbursed in the following situations:

a) When the use of the facility is changed;

b) When, at the end of a period of two years from notification of the aid, the beneficiary commune, public establishment for inter-communal cooperation or department has not incurred an amount of expenditure at least equal to the amount of aid granted;

c) Where the project to extend or change opening hours benefiting from the aid does not meet the criteria that justified the award of the aid within two years of its notification.

Article R1614-95

L’attribution au titre de la deuxième fraction du concours particulier est remboursée dans les situations suivantes :

a) Lorsque l’affectation de l’équipement est modifiée ;

b) Lorsque, à l’expiration d’un délai de deux ans à compter de la notification de l’aide, la commune, l’établissement public de coopération intercommunale ou le département bénéficiaire n’a pas engagé un montant de dépenses au moins égal au montant de l’aide attribuée ;

c) Lorsque le projet d’extension ou d’évolution des horaires d’ouverture bénéficiaire de l’aide ne remplit pas les critères ayant justifié l’attribution de l’aide dans les deux ans suivant sa notification.
