Article R1617-5-2 of the French General Code of Local Authorities

I. – The titular or temporary administrator may receive an allowance for handling funds under the conditions laid down by order of the Minister responsible for the budget.

II. – The administrator is assisted by agents. The instrument setting up the imprest account provides for the use of agents. These agents are appointed by the authorising officer with the agreement of the accounting officer and the administrator.

The agents do not receive an allowance for handling funds. However, when the agent replaces the absent administrator for a period not exceeding two months, he may receive an allowance for handling funds during the actual period in which he performs the administrator’s duties under the conditions laid down by order of the minister responsible for the budget.

III. – A handover is compulsory between the outgoing administrator or his/her authorised representative and the incoming administrator or his/her authorised representative. The incoming imprest administrator or his authorised representative or the outgoing imprest administrator or his authorised representative may give a power of attorney to carry out this formality.

I. – Le régisseur titulaire ou intérimaire peut percevoir une indemnité de maniement de fonds dans les conditions fixées par arrêté du ministre chargé du budget.

II. – Le régisseur est assisté de mandataires. L’acte constitutif de la régie prévoit le recours à des mandataires. Ceux-ci sont nommés par l’ordonnateur sur avis conforme du comptable et du régisseur.

Les mandataires ne perçoivent pas d’indemnité de maniement de fonds. Toutefois, lorsque le mandataire assure le remplacement du régisseur absent pour une durée ne pouvant excéder deux mois, il peut percevoir une indemnité de maniement de fonds pendant la durée effective où il exerce la fonction de régisseur dans les conditions fixées par arrêté du ministre chargé du budget.

III. – Une remise de service est obligatoire entre le régisseur sortant ou son mandataire et le régisseur entrant ou son mandataire. Le régisseur entrant ou son mandataire ou le régisseur sortant ou son mandataire peuvent donner mandat pour accomplir cette formalité.
