Article R163-2 of the French Monetary and Financial Code

Any person who questions the Banque de France about the legality of a cheque without complying with the conditions set out in the first paragraph of article R. 131-5 is liable to a 5th class fine. A repeat offence under this article is punishable in accordance with article 132-11 of the Criminal Code.

The same penalty shall apply to any agent who fails to comply with the provisions of the first paragraph of article R. 131-8.

Article R163-2

Le fait, pour toute personne, d’interroger la Banque de France sur la régularité d’un chèque en méconnaissance des conditions fixées par le premier alinéa de l’article R. 131-5 est puni de l’amende prévue par les contraventions de la 5e classe. La récidive de la contravention prévue au présent article est réprimée conformément à l’article 132-11 du code pénal.

La même peine est applicable au mandataire qui ne se conforme pas aux dispositions du premier alinéa de l’article R. 131-8.
