Article R2-15-5 of the French Code of Criminal Procedure

The right to object provided for in Article 21 of the aforementioned Regulation does not apply to the processing of personal data of the persons mentioned in 1°, 2° and 3° of Article R. 2-15-1 by authorised personnel of the Ministry of Justice, the investigation department and the disaster victim identification unit seized when the purpose of such transmission or consultation is to guarantee the protection of the persons concerned pursuant to i of 1 of article 23 of the same regulation.

The persons mentioned in 1°, 2° and 3° of article R. 2-15-1 may, however, oppose the transmission or consultation of their personal data to other categories of accessors and recipients.

The rights of access, rectification, limitation and opposition provided for in articles 15, 16, 18 and 21 of the same regulation may be exercised by contacting the department responsible for victim support at the General Secretariat of the Ministry of Justice.

Le droit d’opposition prévu à l’article 21 du règlement mentionné ci-dessus ne s’applique pas au traitement des données à caractère personnel des personnes mentionnées aux 1°, 2° et 3° de l’article R. 2-15-1 par les personnels habilités du ministère de la justice, du service d’enquête et de l’unité d’identification des victimes de catastrophe saisis lorsque cette transmission ou cette consultation a pour objectif de garantir la protection des personnes concernées en application du i du 1 de l’article 23 du même règlement.

Les personnes mentionnées aux 1°, 2° et 3° de l’article R. 2-15-1 peuvent en revanche s’opposer à la transmission ou la consultation de leurs données à caractère personnel aux autres catégories d’accédants et de destinataires.

Les droits d’accès, de rectification, à la limitation et d’opposition prévus aux articles 15,16,18 et 21 du même règlement s’exercent auprès du service en charge de l’aide aux victimes du secrétariat général du ministère de la justice.
