Article R2-19 of the French Code of Criminal Procedure

The authorisation referred to in 2° of I of article 15-4 may only be issued to the agent benefiting from the authorisation referred to in the second paragraph of I of the same article.

It shall be issued in writing by a line manager of a sufficient level as referred to in the second paragraph of I of article 15-4.

In the event of an emergency, it may be issued by any means by such a manager or by his representative as part of the department’s on-call duty. It must be confirmed in writing by such a line manager on the first working day following its issue.

Without prejudice to the provisions of articles R. 2-22 to R. 2-24, this authorisation is valid until a judicial decision putting an end to the proceedings has become final.

Article R2-19

L’autorisation mentionnée au 2° du I de l’article 15-4 ne peut être délivrée qu’à l’agent bénéficiant de l’autorisation mentionnée au deuxième alinéa du I du même article.

Elle est délivrée par écrit par un responsable hiérarchique d’un niveau suffisant mentionné au deuxième alinéa du I de l’article 15-4.

En cas d’urgence, elle peut être délivrée par tout moyen par un tel responsable ou par son représentant dans le cadre de l’astreinte du service. Elle doit être confirmée par écrit par un tel responsable hiérarchique dès le premier jour ouvrable suivant sa délivrance.

Sans préjudice des dispositions des articles R. 2-22 à R. 2-24, cette autorisation est valable jusqu’à ce qu’une décision judiciaire mettant fin à la procédure soit devenue définitive.
